At common law, arson was the malicious burning of the dwelling of another. Michigan MCL 750.71 et seq (the burning statute) modifies common law arson and adds first, second, third, fourth, or fifth degree arson.
Assault and Battery
Assault is the threat of injury, battery is the action of causing injury. Often charged together and muddled by statutes, assault and or battery in Michigan begins at MCL 750.81. Assault and battery is subject to Michigan enhanced sentencing.
Auto Theft and Larceny
Michigan governs larceny under MCL 750.356. Some thefts are individually identified, others are lumped together and identified as the method of theft, such as by conversion or false personation.
A criminal defense attorney will balance the tables so that the system treats you fairly, with due process.
Breaking and Entering
MCL 750.110 governs burglary and general breaking and entering by statute. Unlike common law breaking isn't necessary and specific locations are identified individually (see shipping containers and coin operated boxes).
DUI / OWI / Drunk Driving
Michigan takes driving while intoxicated very seriously, with some of the United States most unforgiving laws. It is imperative the everyone charged with impaired driving of any kind hires an attorney immediately. That OWI can follow for many years.
MCL 750.167 is a snapshot of the breadth of disorderly persons. You may be charged with disorderly conduct specific to locations, such as funerals, hunting, or window peeping. It is a controversial statute and the state must be careful how it is enforced (first amendment).
You have Miranda Rights.
Being charged with drug possession, manufacturing, or using in Michigan can carry serious consequences if not defended. Although not always available, these charges unlike many others may be defended based on extraneous circumstances.
Drivers License Restoration
Maintaining or restoring your freedom to drive is very important for most people. Depending on how your drivers license was suspended or terminated determines the process suited for restoring your license.
A felony is a category of crime that is deemed more serious and is accompanied by stricter sentencing than the lesser misdemeanor. Traditionally a felony is a crime that is punishable by imprisonment of one year or more.
You have the right to stay silent.
Michigan and a handful of other states have a specific crime for the unauthorized entry into an occupied private dwelling with the intent to commit a crime within. Depending on crime intended, first, second, or third degree punishments will apply (MCL 750.110a).
Manslaughter is not punishable for more than 15 years. At common law voluntary manslaughter is the intentional killing, in the heat of passion, with adequate provocation. Involuntary may include an act that is a gross deviation from a reasonable standard of care.
Michigan classifies First Degree Murder as the intentional killing with premeditation and deliberation, or felony murder. Any other murder is classified as second degree murder in Michigan (MCL 750.316).
And you have the right to an attorney.
Retail fraud is divided amongst degrees in Michigan most heavily depending on the value of the item violated. Generally a person who alters, transfers, replaces, conceals, or misrepresents the price may be charged with retail fraud (MCL 750.356d).
A person who willfully and maliciously destroys or injures the personal property of another person may be charged with property destruction in Michigan. Punishments are most heavily tied to the value of the property involved.
Weapon offenses do not necessarily involve firearms, but Michigan does categorize firearm offenses in a class of its own (MCL 750.222). Self defense is a common rebuttal to firearm crimes, however Michigan's statute is not as broad as some other states.
